Terms of service
Using anightout means you agree to these terms. The plain- English summary is below the legalese at the end; if the two conflict, the numbered sections control.
1. Who can use this
You must be at least 18 years old and legally permitted to purchase alcohol in your jurisdiction. anightout suggests bars, clubs, and restaurants — if that’s not a product you’re old enough to use, don’t.
You agree to give accurate info when you sign up and to keep your account credentials to yourself. You’re responsible for what happens under your account.
2. How you can use it
You may:
- Create plans, share them with friends, vote on shared plans.
- Leave feedback, ratings, and recap notes.
- Flag venues that are closed, wrong, unsafe, or offensive.
You may not:
- Scrape, crawl, or bulk-download venue data or plans.
- Create accounts by automated means or sell / lease accounts.
- Use the service to harass, impersonate, defame, or send unsolicited messages.
- Upload content you don’t own the rights to, or content that’s illegal where you live.
- Probe or exploit the service for security vulnerabilities without our written permission (responsible disclosure is welcomed — email david.linacre@gmail.com).
3. Your content
You keep ownership of everything you create on anightout — plan names, feedback notes, display names, avatars.
By posting it, you give us a worldwide, non-exclusive, royalty-free license to display, store, and serve your content inside the product (for example: showing your avatar next to your vote in a shared plan, or your note on the post-night recap). This license ends when you delete the content or your account, with a short retention window for backup rotation.
4. Venue information
Venue data — addresses, hours, price level, descriptions, reviews — comes from Google Places and is best-effort. We don’t verify every venue. Before you go, confirm hours, age requirements, dress codes, and accessibility details directly with the venue.
If a venue closes, changes dramatically, or has wrong information on its anightout page, report it from the venue’s page and an editor will review.
5. No warranty, limited liability
anightout is provided “as is.” We don’t promise the venue suggestions will be safe, appropriate for your group, or accurate at the moment you visit. We’re not responsible for what happens during your night out — not the service, not the food, not the drinks, not the people you meet.
To the maximum extent the law allows, our aggregate liability for any claim arising from your use of the service is limited to $100 USD.
6. Termination
You can delete your account at any time from your profile. We can suspend or terminate access if you violate these terms, especially for the prohibited uses in §2. We’ll tell you when we do, unless telling you would defeat the point (for example, if a security issue is ongoing).
7. Changes
We’ll update these terms from time to time. Material changes get a notice on the site and a “last updated” date at the top of this page. Continued use after a change means you accept the new terms.
8. Governing law & disputes
These terms are governed by the laws of the State of Illinois, USA, without regard to conflict-of-law principles. Any dispute that can’t be resolved informally will go to the state or federal courts located in Cook County, Illinois, and you consent to personal jurisdiction there.
If any part of these terms is held unenforceable, the rest still applies.
